New York Suspended License Cases

If you operate a motor vehicle when your license is revoked or suspended you may be charged with Aggravated Unlicensed Operation of a Motor Vehicle. Aggravate Unlicensed Operation of a Motor Vehicle is an extremely serious allegation even though it may start with the failure to simply answer traffic tickets. Aggravated Unlicensed Operation, commonly referred to as an AUO, or a 511, is a section of the New York State Vehicle & Traffic Law under which a motorist is charged for operating a motor vehicle knowing that his or her license, or privilege to drive has been suspended or revoked. AUO in the Third Degree (Vehicle and Traffic Law 511.1) is an Unclassified Misdemeanor. It carries a possible sentence of a fine, a term of imprisonment of not more than 30 days, or both. 

Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree (VTL 511.2), is an Unclassified Misdemeanor punishable by a fine, and either a prison term not to exceed 180 days or a term of probation. A person is guilty of Aggravated Unlicensed Operation of a Motor Vehicle when:

• He or she drives a motor vehicle knowing his or her license is suspended or revoked and has had a previous conviction in the preceding 18 months; or

• The suspension or revocation occurred due to a Chemical Test Refusal; or

• The suspension or revocation is based on a DWI conviction; or

• The suspension was mandatory pending prosecution in a pending DWI case; or

• He or she has 3 or more pending suspensions on three separate dates for failure to answer, appear or pay a fine.

Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree (VTL 511.3), is a Class E Felony, punishable by a fine and a term of imprisonment as provided in the Penal Law, or a sentence of probation. Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree is committed when someone:

• Commits Aggravated Operation in the Second Degree and is operating a motor vehicle while under the influence of alcohol, drugs or a combination thereof; or

• Commits Aggravated Operation in the Third Degree and has 10 pending suspensions imposed on 10 separate dates for failure to answer, appear or pay a fine, or

• Commits Aggravated Unlicensed Operation of a Motor Vehicle in the Third degree and is operating a motor vehicle while under permanent revocation as set forth in section 1193 of the Vehicle and Traffic Law of the State of New York.
