Criminal Mischief Cases 

Many people are totally unaware that they can be charged with Criminal Mischief in the Fourth Degree, a Class A Misdemeanor and can go to jail for up to one year for damaging the property of another person, damaging abandoned buildings, or for interfering with a person’s attempt to call emergency services, including police and fire fighters. 

If you intentionally damage another person’s property that is worth more than $250.00 (possibly an iphone), or if you damage a person’s locked car with intent to steal something, and you have three previous convictions for Criminal Mischief within the previous ten years, you can be charged with Criminal Mischief in the Third Degree, a Class E Felony which carries a maximum of four years in prison. 

If the damaged property is worth more than person one thousand five hundred dollars you may be charged with Criminal Mischief in the Second Degree, a Class D Felony which carries a maximum of seven years in prison. Finally, if you use an explosive to damage the property, you may be charged with Criminal Mischief in the First Degree, a Class B Felony which carries a maximum of twenty five years in prison. 

If you have prior felony convictions, you may face a higher sentence.
