Texting and Distracted Driving Cases

Many people are not aware that Texting While Driving and Distracted Driving cases are very serious allegations. Regardless, these cases can lead to a loss of your license or worse. If you are Texting While Driving, or otherwise driving while distracted (which includes driving while holding and using a cell phone), whether by eating or using a cell phone, and you have an accident that results in physical injury to another person, you may face criminal charges, including Reckless Driving, Vehicular Assault and Homicide if that injury results in death. You may also be sued for the injured person’s property damage, personal injury, or death.

In 2011, the New York State Vehicle & Traffic Law was amended to include texting while driving as a primary offense. Texting While Driving is a 5 point moving violation, and a conviction will significantly move you closer to, or cause you to lose your license because if you receive 11 points on your driver’s license within an 18 month period, your driver’s license will be suspended.

If you have a junior license or a probationary license, and are convicted of Texting While Driving has also you can automatically receive a suspension of your probationary and junior license for 60 days. If you are convicted of a second Texting While Driving within 6 months, your license will be revoked for 6 months, and there will be an additional 60 day revocation if you have a junior license.

If you or a loved one is facing Texting While Driving or Distracted Driving charges, choosing an attorney to defend your case is one of the most important — if not the most important — decisions you will ever have to make. It is absolutely critical that you retain the services of an aggressive, highly experienced criminal defense attorney with a proven track record as soon as you possibly can.

Distracted driving can be devastating to you and to others who you may not even know. Projects such as HANG UP AND DRIVE work to highlight these sometimes life altering split second decisions. Once someone is injured or killed, the unintended consequence of distracted driving cannot be undone.
