In New York, you may be charged with Criminal Sale of a Controlled Substance in the Third Degree, a Class B Felony, which carries a maximum penalty of nine years in prison, for simply handing a narcotic or illegal drug to another person, even if they do not pay you for it. 

You may be charged with Criminal Sale of a Controlled Substance in the First Degree if you knowingly and unlawfully sell:

1. one or more preparations, compounds, mixtures or substances containing a narcotic drug and the preparations, compounds, mixtures or substances are of an aggregate weight of two ounces or more; or
2. methadone and the methadone weighs two thousand eight hundred eighty milligrams or more.

Criminal Sale of a Controlled Substance in the First Degree is a Class A-I Felony, and it carries a maximum sentence of 20 years in prison.

If you have prior felony convictions, you may face a higher sentence.

Consequences of Drug Convictions include and are not limited to the following:

  5. You may be subjected to random drug testing and be required to undergo drug treatment

It should also be noted that if you operate a motor vehicle while under the influence of drugs, you may be prosecuted for Driving While Ability Impaired by Drugs under Vehicle and Traffic Law 1192(4). DWAI Drugs is an Unclassified misdemeanor which carries a maximum sentence of 1 year in jail. It may also be charged as a felony if you have previous DWI or DWAI Drug convictions, and as a felony, you may face up to 7 years in jail.
