The Kalief Browder Tragedy 

The story of twenty-two-year-old Kalief Browder sheds light on how important bail decisions are.  Mr. Browder spent three years imprisoned in Riker’s Island, which is thought to be one of the nation's most violent prisons. Kalief Browder was unjustly arrested for allegedly stealing a backpack when he was only 16 years old, and the court set bail at $3000.00. While in the jail, he was repeatedly beaten, and abused by the staff as well as by other inmates, many of which were captured on video. Mr. Browder's case was eventually dismissed, and he was released from prison.

Despite his release, Kalief Browder continued to suffer from his experience at Riker's Island, and in June of 2015, he hanged himself with an air conditioning cord. His story was the impetus for a nationwide movement for a presumption of pre-trial release in lieu of bail.  Mr. Browder's story is detailed in a six-part documentary TIME: The Kalief Browder Story.

New York Bail Reform

In April 2019, New York State passed a bail reform act to update that expanded a move by Governor Andrew Cuomo to foster a presumption of release in the most misdemeanors and non-violent felonies.  The law is strongly opposed by many prosecutor's offices, and even some defense attorneys.  Nevertheless, it's clear that there was a need for bail reform as evidenced by Mr. Browder's case, and a multitude of similar cases.
